1) Terms and Conditions
a. Photographer (Tianna Williams) agrees to provide Client with photography services on the wedding date stated above, subject to external variables beyond their control (e.g. weather, location/venue restriction, etc.)
b. Client agrees to give Photographer sufficient warning of key events at the wedding to give the Photographer time to prepare (i.e. first look, bouquet toss, cake cutting, speeches, etc.)
c. Photographer will endeavour to get photographs of as many key moments as possible, which may be limited by guests’ cooperation in having their photo taken or unforeseen obstacles (i.e. inclement weather, light availability, etc.)
d. Client agrees that Photographer shall be given precedence in taking photographs over guests with cellphone cameras and other devices. Photographer cannot be held responsible for lack of photographs or poor quality of photographs if guests are interfering with Photographer’s work.
e. Client acknowledges Photographer may be limited in scope by rules of the location of the ceremony and/or reception. (i.e. regulations to where Photographer may stand, how many photos may be taken, etc.)
f. Photographer agrees to provide basic editing and delivery of high-resolution digital files within sixty (60) days of the wedding day, on USB storage or available for download from an online gallery.
g. Client agrees to provide a meal for Photographer if Photographer’s attendance is required for greater than five (5) hours.
2) Change of Date and/or Venue
Client agrees to notify Photographer by phone or email at their earliest convenience should a change of date and/or venue occur. In situations where the new venue requires substantial travel, Client agrees to pay for reasonable logistical expenses.
Furthermore, Client understands that Photographer may be unavailable on an alternate date. In such circumstances, Client agrees to liaise with Photographer to find a mutually agreeable solution. Client accepts that they may forfeit some/all of monies paid.
3) Copyright. Photographer shall maintain the copyright of all photographs. Photographer grants Client permission to make copies of the images for personal use by Client and their family and friends. Sale, publication, or any other commercial use is specifically prohibited without the prior written consent of Photographer.
4) Editing. Photographs may not be edited in any way, including colour correction, sharpening, or filters. However, the photos may be resized and cropped for personal use, such as printing or social media.
5) Privacy. Photographer reserves the right to use the photos both privately and publically (i.e. social media, portfolio, etc.) Client may request that images be taken down at any time which Photographer will endeavour to accommodate.
6) Cancellation
a. By Client:
Client may cancel this agreement at any time prior to the event. Upon cancellation, Client will be entitled to a refund of any monies paid, except for the non-refundable deposit of $250.00
b. By Photographer:
Photographer may cancel this Agreement at any time. If Photographer cancels, they must suggest a suitable, replacement Photographer, subject to Client’s approval. In the alternative, Photographer shall refund all monies previously paid by Client, including the non-refundable deposit.
c. Illness/Injury:
In the unlikely event that Photographer falls gravely ill and/or is incapacitated prior to and/or on agreed wedding date, Client understands that all reasonable efforts will be made to find a suitable replacement photographer. Client agrees to terminate this agreement upon rejection of the substitute photographer and acknowledge that a full refund of all monies paid will be processed within ten (10) business days.
7) Entire Agreement. The Parties acknowledge and agree that this Agreement represents the entire agreement between the Parties. In the event that the Parties desire to change, add, or otherwise modify any terms, they shall do so in writing to be signed by both parties.
The Parties agree to the terms and conditions set forth above as demonstrated by the submission of this form.
